Sickening twist after brothers impregnate 12-year-old sister
Two Amish brothers who plead guilty to molesting their 12-year-old sister last month will not serve time in state prison, though there is now a motion to revoke their probation.
Aaron Schwartz, 22, his 18-year-old brother Petie Schwartz, and two of their younger brothers had sex with their sister who was between the ages of 12 and 13.
In June this year, the sister sought medical treatment for being pregnant, KY3 reported, which lead to the elder Schwartz brothers being charged with six counts of statutory rape.
Earlier in September, the brothers plead guilty to two counts of third-degree child molestation, in connection to the case.
The two brothers were spared jail earlier this month.
Instead, they were sentenced to probation for five years, given 100 hours of community service, instructed to attend the Missouri Sex Offender Treatment Program and told they must each write a letter to the Amish community in Seymour apologising for their actions, the Webster County Citizen reported.
The brothers also have to pay $250 each to the Law Enforcement Restitution Fund.
“These two young men would’ve been eaten alive in the state prison system,” Webster County Prosecuting Attorney Ben Berkstresser said of his decision.
Berkstresser acknowledged the punishment for the brothers would be criticised, the Webster County Citizen reported, though he said “there isn’t a question of what happened”.
He also said the sister had the baby just weeks ago and that one of the four brothers was the father.
However, now a motion has been filed to revoke their probation.
The prosecutor on the case has argued the elder Schwartz brothers have already had contact with their 13-year-old sister which violates their probation, KY3 reported on September 25.
By having contact with their sister, thus violating their probation, the two could spend 15 years in prison - something the judge will have to decide.
Berkstresser had said previously the two brothers were offered a lesser plea deal of child molestation due to the lack of evidence and cooperation with those connected to the case, the station reported.
